1. Acceptance of Terms

By accessing or using NymStorm (“the Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you may not use the Service. We may update these Terms from time to time; your continued use constitutes acceptance of the changes.

2. Description of Service

NymStorm provides an online platform for “brainwriting” sprints: participants submit ideas anonymously under random animal aliases, build on others’ ideas, and vote on outcomes. The Service is provided as a Minimum Viable Product (MVP) – we are testing whether teams find value in anonymous async brainstorming. Features may change, and we make no guarantees about uptime or feature completeness.

3. Eligibility

You must be at least 13 years old to use NymStorm. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements.

4. Accounts & Magic Link Login

  • You must provide a valid email address to receive magic login links. You are responsible for keeping your email account secure – anyone with access to your email can log into yourNymStorm account.
  • You may not create multiple accounts to manipulate voting or anonymity. We reserve the right to detect and suspend abusive accounts.
  • You are responsible for all activity that occurs under your animal alias(es). If you suspect unauthorised access, contact us immediately.

5. Anonymous Content & Conduct

All ideas, thread replies, and votes are posted anonymously under a randomly assigned animal alias. However, anonymity does not mean impunity. You agree not to post:

  • Illegal content (e.g., threats, harassment, child exploitation material).
  • Defamatory, hateful, or discriminatory statements.
  • Spam, promotional content, or irrelevant material.
  • Malicious code or attempts to compromise the Service.
  • Personally identifiable information of others (e.g., real names, emails).

If you violate these rules, we may remove your content, suspend your account, and, for serious violations, disclose your identity to law enforcement.

6. Intellectual Property

Your ideas remain yours. By submitting an idea, reply, or any content toNymStorm, you retain all ownership rights. You grant NymStorm a non‑exclusive, royalty‑free, worldwide license to store, display, and allow other participants to build upon your content within the Service for the purpose of running brainstorming sprints.

You also grant other participants the right to read, reply to, and vote on your anonymous ideas. However, no participant may copy or reproduce your idea outside of NymStorm without your permission – because they do not know who you are, they must obtain your consent through other means if you choose to reveal yourself.

NymStorm claims no ownership over any user‑submitted ideas.

7. Prohibited Uses

  • Reverse engineering, scraping, or automated access (bots).
  • Attempting to break anonymity (e.g., using identifying language or metadata).
  • Interfering with voting integrity (e.g., vote brigading).
  • Using the Service for any illegal purpose.

8. Termination & Account Deletion

You may delete your account at any time via your profile settings. Upon deletion:

  • Your email and alias mapping are permanently removed.
  • Your anonymous ideas remain as orphaned content (no longer linked to you).
  • If you want your ideas fully removed, you must request that before deleting your account.

We may suspend or terminate your account immediately for violating these Terms, without prior notice.

9. Disclaimers & “As‑Is” Service

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that:

  • The Service will be uninterrupted, secure, or error‑free.
  • The anonymity mechanisms are completely foolproof (e.g., metadata leaks).
  • Any ideas generated will be useful or valuable.

You use NymStorm at your own risk. We are not responsible for any decisions you make based on anonymous ideas.

10. Limitation of Liability

To the maximum extent permitted by law, NymStorm and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service – even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us to use the Service (which is $0 for the MVP phase) or $10, whichever is greater.

11. Third‑Party Services

NymStorm relies on third‑party infrastructure (Turso, Cloudflare, an email delivery provider). We are not responsible for their uptime, security breaches, or changes to their services. Your use of those third‑party services is governed by their own terms and privacy policies.

12. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of [Your Country/State], without regard to conflict of law principles. Any dispute arising from these Terms or your use of NymStormshall be resolved through binding arbitration in [City, Country], unless the claim qualifies for small claims court. You waive the right to participate in a class action.

13. Changes to the Service

We may modify or discontinue NymStorm (temporarily or permanently) at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

14. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and NymStorm.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
  • No Waiver: Our failure to enforce any right does not waive that right.
